Purpose
These Terms of Sale govern the sale, by Elia Interactive (EURL with a share capital of €1,000, RCS Nanterre 834 492 894, 22B Avenue de la Division Leclerc, 92320 Châtillon, France, contact@eliacover.com), under the Eliacover brand, of digital books created with Elia, their extras (audiobook, translation, video, extra pages, edits, printer file…), printed books, prepaid credit top-ups and gift cards, to consumers, via the eliacover.com website and the Eliacover app. All prices are in euros including VAT.
Digital books: preview, price and payment
Three ways of creating are offered: an album of your photos (“Your photos”), an illustrated book or comic in which you are the hero (“You're the hero”) and a book or magazine in your image (“Starring you”). Before paying, a free preview shows you the beginning of your book, without a card, within the limits shown in the app. The price of a book depends on the way of creating and the number of pages; it is shown in euros including VAT on the Pricing page and before payment, and the price shown when you confirm is the one that applies. The digital book is paid once, when its full creation is launched: by direct payment (any balance you have is used first; a minimum payment amount may apply, in which case the surplus stays on your balance) or with your balance. It includes online reading, its share link and its PDF file. 16-page book: this format is digital only; it can never be printed, even later, and no print order will be accepted for it. Before choosing it, you expressly confirm this by ticking the box “I understand: this 16-page book can’t be printed”; the date and time of this confirmation are kept with your book. If the creation of a book fails, the reserved amount is returned to your balance.
Prepaid credit and top-ups
Credit is a prepaid balance in euros that can only be used for Eliacover books, extras and products. It is funded by optional one-off top-ups (no subscription, no automatic renewal), by gift cards and by any surplus of a direct payment; some top-ups may include a bonus, shown before payment. Amounts are shown in euros including VAT before payment. Credit is available immediately and does not expire as long as the account is active. It is not transferable or refundable in cash, except when the right of withdrawal is exercised; the bonus offered is never refundable.
Gift cards
Gift cards are sold at a fixed price in euros including VAT; their amount is added to the recipient's credit when they use the code. They are valid for two years from purchase, can be sent on a scheduled date (up to one year in advance) and are used with an Eliacover account. A card not used by its expiry date is lost; it is not refundable in cash.
Referral programme « Invite your loved ones »
Each customer has a personal invitation link. A person who creates an account through this link, or by opening a book shared by this customer, gets a discount on their first digital book (€3 unless a different amount is shown before payment), only once; they keep it even if the referrer has reached their limit. For each first digital book paid for by an invited person, the referrer receives a reward (€5 unless a different amount is shown on their « Invite your loved ones » page) in their kitty: the reward is pending for 7 days, then becomes available; it is cancelled if the order is refunded or the payment is disputed. Rewards are kept on hold until the referrer pays for their first book; they are then valid for 12 months from that unlocking (or from when they become available, if later). A referrer receives at most 20 rewards per 12-month period. The kitty can only pay for all or part of an Eliacover digital book, never a printed book; at checkout it is used before prepaid credit, and either can be turned off. It cannot be transferred, refunded or exchanged for cash. At checkout, the invited person sees the referrer's displayed name (by default their first name and the initial of their last name), which the referrer can change on the « Invite your loved ones » page. To prevent abuse, Eliacover compares the technical fingerprint of payment cards (provided by its payment provider, without ever knowing the card number), email addresses, devices and connections, with no biometric processing; a reward obtained by referring oneself or abusively may be refused or cancelled. Eliacover may change or end the programme at any time; rewards already earned remain usable until they expire.
Printed books: ranges, ordering and delivery
Only a book of at least 26 pages can be printed: a book of fewer than 26 pages, in particular the 16-page book, is digital only and no print order is possible for it. A printable book can be ordered, in one or more copies, in one of our two ranges: Essentiel (hardcover or softcover) and Signature (printed in France, hardcover, with paper, finish and presentation options). The price depends on the range, format, binding, number of pages, options and number of copies; it is shown in euros including VAT, delivery included, before any order. The printed book is paid when it is ordered, in addition to the digital book already paid for, or together with it, at creation, in a bundle. It is made to order by our printing partners and shipped to the address given. Delivery to mainland France only (Corsica included, overseas territories excluded). Indicative lead times, in working days after the order leaves: Essentiel 7 to 9 days, Signature 3 to 6 days; Express delivery may be offered depending on the options chosen. The estimated delivery date is shown before ordering; the order deadlines shown for holidays (Christmas, Mother's Day…) include a safety margin. Parcel tracking is available in the account and by email as soon as the book ships. In the event of late delivery, you have the rights provided by Articles L.216-1 et seq. of the French Consumer Code.
Right of withdrawal
Printed books are goods made to the customer's specifications and clearly personalised: the right of withdrawal does not apply (Article L.221-28, 3° of the French Consumer Code). The digital book and its extras are digital content supplied immediately: the customer expressly waives the right of withdrawal when launching their creation, through a dedicated checkbox (Article L.221-28, 13°). Credit that has been topped up but never used can be refunded on request within 14 days of purchase (excluding any bonus offered).
Defective book
If there is a printing defect or damage during shipping, the customer contacts us within 30 days of receipt, with a photo: the book will be reprinted or refunded. The statutory guarantees of conformity and against hidden defects apply.
Payment
Payment is made by bank card or by the other payment methods offered at checkout, via our payment provider Stripe. Eliacover never sees or stores card numbers. An invoice is available in the account.
Complaints and mediation
Any complaint can be sent to contact@eliacover.com. If a dispute remains unresolved, consumers can turn to the CM2C consumer mediator free of charge (see the Legal Notice).
Governing law
These Terms of Sale are governed by French law, without prejudice to the more protective mandatory provisions of the law of the consumer's country of residence. Consumers may bring proceedings, at their choice, before any court with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they lived when the contract was concluded or when the harmful event occurred (Article R.631-3 of the French Consumer Code).
