Purpose

These Terms of Service ("Terms") govern access to and use of Eliacover, a service published by Elia Interactive, available on the eliacover.com website and in the app.eliacover.com app. Eliacover lets you create, with Elia, Eliacover's artificial intelligence, digital books and, optionally, printed books, in three ways: an album of your photos (“Your photos”), an illustrated book or comic in which you are the hero (“You're the hero”) and a book or magazine in your image (“Starring you”). By creating an account or using the service, you accept these Terms in full.

Creating with Elia, Eliacover's artificial intelligence

The texts, illustrations, layout and, for the audiobook, the voices, sounds and music of your books are created by Elia, Eliacover's artificial intelligence, which relies on artificial intelligence models from providers (list in the privacy policy). What you provide (photos, documents, scans, PDFs, voice messages, a website address, answers to Elia's questions) is material for this creation: it is not reproduced as such in the book, except your photos in the photo album or if you ask for it. Artificial intelligence can make mistakes: read your book again before sharing, publishing or having it printed.

Registration

Registration is open to any natural person of legal age. Users agree to provide accurate information and to keep their login details confidential. An account is strictly personal. Sign-in uses an email address (password or sign-in link sent by email) or a Google account. Audience measurement (visit statistics) is optional: it is only turned on with the user's consent, has no effect on access to the service, and can be set at any time via the “Manage cookies” link or in the account settings (Privacy section).

Session recording in the app

When the user is signed in to the app at app.eliacover.com, Eliacover records how their sessions unfold (screens shown, clicks, scrolling, text typed, errors, technical information and approximate location (city) derived from the IP address, which is not stored) in order to assist them, understand and fix errors, and improve the service. Authorized members of the Eliacover team may replay a session or follow it live, without ever being able to act on the user's behalf. Never recorded: passwords, codes received by email or used for authentication, and payment card details. Recordings are hosted by Eliacover in France, accessible only to the authorized team and deleted after 30 days. Nothing is recorded on the eliacover.com website. Details are provided in the privacy policy ("Session recording in the app").

Prices, free preview and payment

Registration is free. Before paying, you can see a free preview of your book (for example the cover and the first pages, depending on the way of creating), without a card, within the limits shown in the app (in particular one free photo album preview per account). Every book and every extra has a price in euros including VAT, shown on the Pricing page and before each payment; the price shown when you confirm is the one that applies, even if the price list changes afterwards. The digital book is paid once, when its full creation is launched, by direct payment (card or another method offered at checkout) or with your account balance, a prepaid credit in euros funded by top-ups, gift cards or the surplus of a payment. The printed book is paid when it is ordered, even months later, unless it is paid together with the digital book in a bundle. There is no subscription. If the creation of a book fails, the reserved amount is returned to your balance. 16-page book: this format is digital only and cannot be printed; you confirm this by ticking a box before choosing it. A book can only be printed from 26 pages. Payment is secured by Stripe. Detailed terms of sale are set out in the Terms of Sale.

Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium where performance has begun after the consumer's prior express consent and express waiver of the right of withdrawal (13°), nor to goods made to the consumer's specifications or clearly personalised, such as printed books (3°). By launching the full creation of a book or of a paid extra, you request its immediate performance and waive your right of withdrawal for that content; this consent is collected through a dedicated checkbox when you launch it.

Intellectual property

Documents generated by the user via Eliacover belong to the user. Eliacover retains intellectual property rights over the platform, templates, algorithms and source code. The user grants Eliacover a limited license to process their content (text, images, face photos) for the sole purpose of providing the service.

Acceptable use

Users agree not to use Eliacover to create deepfakes or defamatory, unlawful or pornographic content, or content that infringes the rights of others; detailed rules are set out in the usage charter. Using another person's face requires their consent (for a child, that of the holders of parental authority), which the user confirms in the app. Eliacover reserves the right to suspend any account in breach. Faces: using photos showing people is subject to the user's explicit consent to face processing, and the user undertakes to use it only for people who have agreed to this processing. In the photo album, recognising faces person by person (grouping photos of the same person, via Amazon Rekognition) is an option the user turns on themselves, when it is offered. Purposes, providers and retention periods are detailed in the privacy policy and on the “Faces and privacy” page. Audiobook: the voices, sounds and music of the audiobook are created by artificial intelligence; the voices are synthetic voices created from a description (age, tone, character): no real voice is recorded, reproduced or cloned, and the player says so (“Voices, sounds and music created with Elia, Eliacover's artificial intelligence”).

Liability

Eliacover strives to keep the service available 24/7 but does not guarantee uninterrupted availability. Books are created by Elia from the user's material and requests, and the user remains responsible for how they use them (sharing, publishing, printing); Eliacover applies the checks described in the usage charter, but content generated by artificial intelligence may contain errors, which the user checks before sharing it. Nothing in these Terms excludes or limits Eliacover's liability for gross negligence, wilful misconduct or personal injury, nor the rights consumers have under the law, in particular the statutory guarantees of conformity and against hidden defects. Towards a business user, and to the extent permitted by law, Eliacover's liability is limited to the amounts paid during the last 12 months.

Termination

Users may terminate their account at any time from their account settings. Termination results in the deletion of all personal data in accordance with our privacy policy. Eliacover may terminate an account in the event of a breach of these Terms, after notice.

Complaints and mediation

Any complaint can be sent to contact@eliacover.com. In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, every consumer also has the right to use a consumer mediator free of charge — see the Legal Notice for the competent mediator's contact details.

Governing law

These Terms are governed by French law, without prejudice to the more protective mandatory provisions of the law of the consumer's country of residence. In the event of a dispute, after an attempt at amicable resolution (see “Complaints and mediation”), consumers may bring proceedings, at their choice, before any court with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they lived when the contract was concluded or when the harmful event occurred (Article R.631-3 of the French Consumer Code). For business users, the courts of Nanterre have sole jurisdiction.
